Terms of service
The agreement between you and us when you use MaxTrack.

1. Who we are
MaxTrack is the training and coaching platform operated by Nexcona LTD. In these terms, "we" and "us" mean Nexcona LTD, and "you" means the person using the site or holding an account.
By creating an account or making a purchase, you agree to these terms. If you do not agree with them, please do not use the platform.
2. Your account
You need an account to buy or access paid content. You agree to provide accurate information, to keep your password secure, and to be responsible for activity that happens under your account.
Accounts are personal. Please do not share your login, and do not create an account on behalf of someone else without their permission.
3. Purchases, prices, and tax
Prices are shown on each course, cohort, or resource page in the currency indicated. Payment is handled by Stripe. We do not see or store your full card details.
Applicable taxes are included in or added to the price as shown at checkout, and are set out on the invoice we email you after payment.
We may change prices at any time, but a change never affects a purchase you have already completed.
4. Access and licence
When you buy a course, cohort, or resource, we grant you a personal, non-transferable, non-exclusive licence to use it for your own learning and your own work.
You may not:
- share, resell, sublicense, or publish the content;
- give others access to your account or to paid material;
- use the material to build or deliver a competing training product without our written permission.
Course access lasts for the period stated on the course page. Where an access period applies, it starts when your payment is confirmed.
5. Live cohorts
Cohorts run to a published schedule with a limited number of seats. Session times, joining details, and any recordings are provided through your account.
We may reschedule a session where necessary. If we cancel a cohort outright, you are entitled to a full refund.
Please treat instructors and other participants with respect. We may remove anyone whose conduct disrupts a session.
6. Acceptable use
Do not attempt to break, overload, or gain unauthorised access to the platform, and do not upload anything unlawful or harmful. We may suspend accounts that put the service or other users at risk.
7. Our content
All course material, templates, written content, and branding on this site remain our property or that of our licensors. Nothing in these terms transfers ownership to you.
Work you produce using our templates is yours. We claim no rights over your project data or deliverables.
8. Refunds
Self-paced courses may be refunded within 14 days subject to the conditions in our refund and cancellation policy, which forms part of these terms.
9. Availability
We work to keep the platform available, but we do not guarantee uninterrupted service. Maintenance, third party outages, and factors outside our control can cause downtime.
We may update or improve course content over time. Where a change is significant, existing purchasers keep access to the version they bought for their access period.
10. No guarantee of outcomes
MaxTrack provides professional education. It does not guarantee any particular job, certification, promotion, salary, or project result. Decisions you make on your own projects remain your responsibility, and our material is not a substitute for professional judgement or independent advice.
11. Limitation of liability
To the extent permitted by law, our total liability for any claim connected with the platform is limited to the amount you paid us for the item the claim relates to, in the twelve months before the claim.
We are not liable for indirect or consequential loss, including lost profit, lost data, or business interruption. Nothing here excludes liability that cannot lawfully be excluded.
12. Suspension and termination
You may stop using the platform at any time and may ask us to close your account. We may suspend or close an account that breaches these terms, or where required by law. Where we close an account without cause, we will refund any unused access period.
13. Changes to these terms
We may update these terms as the platform changes. The date at the top of this page shows the current version. Where a change materially affects your rights, we will tell account holders by email.
14. Governing law
These terms are governed by the laws of Canada and of the province in which Nexcona LTD is registered, and the courts of that jurisdiction have non-exclusive jurisdiction over any dispute.
